Rejecting an emergency appeal from the the Biden administration, the Supreme Court gave Texas officials permission to detain, jail and deport migrants suspected of illegally enter the US via the Texas border.
In December, 2023 Texas Governor Abbott signed immigration enforcement law known as, SB 4. Justifying the necessity of the law at a December press conference Abbott stated,
“Biden’s deliberate inaction has left Texas to fend for itself”.
The Texas law makes illegally entering the US a state crime with a penalty of 180 days in jail followed by deportation. Those who refuse to leave the country can be charged with up to 20-year sentences.
In January Biden’s justice department sued to prevent the law from taking effect. The Biden administration argued SB 4 interfered with federal authority over the border.
Since Biden came into office, a historic record of ten million and counting unvetted migrants have illegally crossed into the US, straining US resources and endangering national security. Despite this historic invasion Biden accepts no blame and is refusing to course-correct.
Biden could secure the border immediately by reinstating the Trump-era immigration enforcement policies he reversed within the first days of his presidency. But, unfortunately, the Biden administration has no interest in securing the US border.
Although this is not the final decision- the dispute is playing out among lower courts- for now, it is a win for American sovereignty and the American people, and a loss for the Biden administration.
The decision was 6-3- liberal justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented.
